TERMS OF SERVICE

Welcome to Hue Got Styled by Neeti Sarkar. By booking a service, purchasing a digital product, or engaging with our content, you agree to be bound by the Terms of Service set out below. Please read them carefully before proceeding.

 

These Terms apply to all services offered under the brand Hue Got Styled by Neeti Sarkar, including in-person colour analysis sessions, virtual colour analysis, styling consultations, digital reports, and any other products or educational content (collectively referred to as 'Services').

1. About the Business

Hue Got Styled by Neeti Sarkar is an independent colour analysis and personal styling service based in Bangalore, India, operated by Neeti Sarkar, a Mastery (In-Person Trained, Internationally) Certified Colour Analyst (16-23 Season System) and Certified Personal Stylist.

Details, inclusions, and pricing for each service are outlined on our website. Service offerings are subject to change at our discretion.

 

3. Bookings and Payment

3.1 Booking Process All bookings are made via our official website. A booking is considered confirmed only upon receipt of full payment only.

3.2 Payment Payment is required in full at the time of booking. We accept payments via UPI, bank transfer, and all major debit and credit cards. Cash payments are not accepted.

Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. International clients may be quoted in USD or INR as communicated at the time of enquiry.

3.3 Pricing Changes We reserve the right to revise our pricing at any time. Any changes will not affect bookings that have already been confirmed and paid for.

3.4 Client Consultation Form Deadline Upon confirmed payment, you will receive a booking confirmation email along with a client consultation form. This form must be completed and returned to us at least 48 hours before your scheduled appointment. Failure to do so will result in the session being cancelled and rescheduled subject to availability. No refund will be issued in such cases, as the slot will have been held exclusively for you.

3.5 Client Acknowledgement of Accuracy By completing your booking, you confirm that all information provided, including photographs, personal details, and responses on the consultation form, is accurate and complete to the best of your knowledge. Hue Got Styled by Neeti Sarkar cannot be held responsible for inaccurate results arising from incorrect or misleading information submitted by the client.

 

4. Cancellation, Rescheduling, and No-Show Policy

4.1 Cancellations by You

• Cancellations made 72 hours or more before the scheduled session: eligible for a full refund or credit toward a future session.

• Cancellations made within 72 hours of the session: No refund will be issued. Only rescheduling as per our convenience is allowed.

All cancellation requests must be submitted in writing via email or WhatsApp message.

4.2 Rescheduling

• You may reschedule your appointment at no charge if notice is given at least 72 hours in advance.

• Rescheduling requests made within 72 hours of the session are subject to availability.

• A session may be rescheduled only once. Subsequent rescheduling requests will be treated as a new booking.

4.3 No-Show Policy If you do not attend your session without prior notice, the session will be forfeited and no refund or credit will be issued. After two no-shows, we reserve the right to decline future bookings.

4.4 Delay In Arrival If you arrive more than 15 minutes after your scheduled appointment time, we reserve the right to treat the session as a no-show. Late arrivals impact the sessions of other clients and we are unable to guarantee that a full session can be completed within the remaining time. In such cases, the session will be forfeited and no refund or credit will be issued. If you anticipate being late, please inform us as soon as possible. We will do our best to accommodate you where our schedule allows, but this cannot be guaranteed.

4.5 Cancellations by Hue Got Styled In the unlikely event that we need to cancel a confirmed session due to illness, emergency, or circumstances beyond our control, we will notify you as soon as possible and offer either a full refund or priority rescheduling at your convenience. We shall not be liable for any additional costs, losses, or inconveniences arising from such cancellations.

4.6 Group Appointments For couple or group sessions, all participants must be present at the scheduled appointment time. If any participant is absent or significantly delayed, the session may need to be rescheduled for the entire group. Rescheduling in such cases will be subject to availability and the terms outlined in Section 4.2.

 

5. Refund Policy

Refunds are available only in accordance with the cancellation terms outlined in Section 4.

All digital products, including PDF colour reports, digital style guides, and downloadable content, are non-refundable once delivered or access has been granted, as they constitute personalised, immediately accessible content.

If you experience a technical issue preventing access to a digital product, please contact us within 7 days of purchase and we will make reasonable efforts to resolve the issue.

6. Session Requirements and Client Responsibilities

6.1 In-Person Sessions for Individual and Group Sessions

• Age Requirement: 18+

For the most accurate colour analysis results, clients are advised to:

• Arrive with clean skin — free of any type of makeup, foundation, tinted moisturiser, and heavy skincare products.

• Avoid wearing any pigmented products including lip colour, blush, bronzer, or eyeshadow /eyeliner/kajal/mascara to the session. If you have an artificial tan or have used self tanner, we will not proceed with the session.

• Come with your natural hair colour visible, or inform us in advance if your hair is coloured, highlighted, or otherwise chemically treated (through the consultation form received upon booking your appointment).

• Wear a simple, neutral-coloured top if possible (grey, white, beige). Avoid tops/shirts with collar/high-neck.

• Avoid coloured or tinted contact lenses for the session. If you wear prescription lenses, clear lenses are preferred; otherwise, please bring your glasses as an alternative.

• Jewellery including earrings, necklaces, and other accessories should be removed before the session begins, as metals and coloured stones can interfere with the draping process.

• Spectacles will need to be removed for portions of the session. If you wear prescription glasses and are unable to see without them, please let us know.

Failure to follow these guidelines may affect the accuracy of your results.

• Sessions are conducted at a private home studio. Children aged 16 and below are strictly not permitted on the premises during appointments. We request that clients make alternative arrangements for childcare prior to their session.

• Food and beverages (including water bottles, coffee, and snacks) are not permitted in the studio. This is to protect the draping fabrics, colour tools, and materials used in your analysis. We kindly request that you have a meal before arriving.

6.2 Nature of Service and Disclaimer

Colour analysis is an interpretive, education-based service. All recommendations, including colour palettes, digital reports, and styling guidance, are based on professional expertise and the information provided by the client. Results may vary depending on individual characteristics, lighting conditions, and personal implementation.

 

Please note that results may also differ across practitioners and colour systems. Hue Got Styled by Neeti Sarkar makes no guarantees regarding specific outcomes. Our services are intended as guidance only and do not constitute medical, dermatological, or psychological advice. Clients are encouraged to use their own discretion when applying the recommendations provided.

7. Intellectual Property

All content created and delivered by Hue Got Styled by Neeti Sarkar, including but not limited to colour reports, style guides, digital palettes, written content, imagery, templates, educational materials, and social media content, is the exclusive intellectual property of Hue Got Styled by Neeti Sarkar and is protected under applicable copyright law.

You may use the materials delivered to you for your own personal, non-commercial purposes only. You may not:

• Reproduce, copy, distribute, or share the materials with third parties on any platform, online or offline.

• Use the materials for commercial purposes, resale, or professional training.

• Present our content, palettes, or reports as your own work.

8. Photography, Testimonials, and Promotional Use

We may request your consent to use before-and-after photographs, feedback, or testimonials for promotional purposes (including on our website, social media, and marketing materials).

Your consent will always be sought explicitly and in writing (via the consultation form) before any such use. You have the right to withdraw consent at any time by writing to us, after which we will remove your images or testimonials from future use within a reasonable timeframe.

Hue Got Styled by Neeti Sarkar will never share, publish, or use client photographs or personal information without prior consent.

9. Privacy and Confidentiality

We take your privacy seriously. All personal information, photographs, and data collected during the booking and service process are:

• Stored securely and used solely for the purpose of delivering your services.

• Treated as strictly confidential.

• Never sold, shared, or distributed to third parties without your consent.

By booking our services, you consent to us collecting and using your personal data as described above and in our Privacy Policy. Our data practices are consistent with applicable Indian data protection regulations.

10. Digital Products and Delivery

Digital products (including colour reports, style guides, and other downloadable resources) will be delivered via email or a secure client portal within the timeframe communicated at the time of purchase.

Please ensure that the email address provided at booking is accurate and active. Hue Got Styled by Neeti Sarkar shall not be responsible for non-delivery due to an incorrect email address or messages directed to spam folders.

All digital products are for the personal use of the purchasing client only and may not be shared, forwarded, or reproduced (see Section 7).

11. Service Validity and Expiry

Bookings and gift vouchers must be redeemed within 12 months of purchase. Services not used within this period will lapse without refund.

12. Communication and Response Times

We endeavour to respond to all enquiries received via email, WhatsApp, or our website within 24 to 48 hours on working days (Monday through Friday, excluding public holidays). Enquiries received on weekends or public holidays will be addressed on the next working day.

Response times may vary depending on the volume and complexity of enquiries. Hue Got Styled by Neeti Sarkar does not guarantee responses within a specific timeframe but will always make reasonable efforts to get back to you promptly.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Hue Got Styled by Neeti Sarkar shall not be liable for:

• Any indirect, incidental, or consequential losses arising from the use of our services or digital content.

• Decisions made regarding wardrobe, shopping, or personal presentation based on our recommendations.

• Losses or damages arising from circumstances beyond our reasonable control, including technical failures, force majeure events, illness, or natural disasters.

Our total liability in any circumstance shall not exceed the amount paid by you for the specific service in question.

14. Client Conduct

We are committed to providing a respectful, inclusive, and professional environment for all clients. We ask that clients engage with us in a courteous and respectful manner across all channels of communication.

Hue Got Styled by Neeti Sarkar reserves the right to decline or discontinue service at any time if a client is found to be behaving in a manner that is disrespectful, abusive, discriminatory, or otherwise inappropriate. In such cases, no refund will be issued for services already partially rendered.

15. Professional Exclusion Policy

Colour analysis services offered by Hue Got Styled by Neeti Sarkar are intended exclusively for personal use by private individuals. In order to protect the integrity of our methodology, tools, and intellectual property, we do not offer services to:

• Practising colour analysts, regardless of the system or institution they are trained in

• Formally trained or untrained individuals offering colour analysis services independently or as a part of other styling/image consulting/beauty/fashion design services

• Individuals currently undergoing training in colour analysis, in any system or program

• Individuals who have studied colour analysis as part of a broader course or program, including but not limited to image consulting, personal styling, fashion styling, or related fields.

Our sessions are personal consultations designed for clients seeking guidance on their own colouring and wardrobe. They are not a platform for observing methodology, acquiring tools, or gaining professional exposure to our systems or approach.

 

If you fall into any of the above categories, we would encourage you to seek your colour analysis from the institution or trainer you are studying or have studied with, as they will be best placed to work within the system you are learning.

 

By completing your booking and submitting your consultation form, you confirm that none of the above applies to you. If it is found at any point - before, during, or after a session - that a booking was made in breach of this policy, Hue Got Styled by Neeti Sarkar reserves the right to cancel the session immediately with no refund, and to take appropriate legal action in the event of misrepresentation or misuse of our intellectual property, systems, or materials.

16. Amendments to These Terms

We reserve the right to update or amend these Terms of Service at any time. Any changes will be posted on our website with a revised effective date. Continued use of our services following an update constitutes acceptance of the revised Terms.

It is your responsibility to review these Terms periodically. We recommend saving or printing a copy for your records at the time of booking.

17. Governing Law and Dispute Resolution

These Terms of Service are governed by and shall be construed in accordance with the laws of India. Any disputes arising from these Terms or from the services provided shall first be attempted to be resolved informally through direct communication.

 

In the event that a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.

By booking a service or purchasing a product from Hue Got Styled by Neeti Sarkar, you confirm that you have read, understood, and agreed to these Terms of Service.
