TERMS OF SERVICE

Welcome to Hue Got Styled by Neeti Sarkar. By booking a service, purchasing a digital product, or engaging with our content, you agree to be bound by the Terms of Service set out below. Please read them carefully before proceeding.

 

These Terms apply to all services offered under the brand Hue Got Styled by Neeti Sarkar, including in-person colour analysis sessions, virtual colour analysis, styling consultations, digital reports, and any other products or educational content (collectively referred to as 'Services').

1. About the Business

Hue Got Styled by Neeti Sarkar is an independent colour analysis and personal styling service based in Bangalore, India, operated by Neeti Sarkar, a Mastery (In-Person Trained, Internationally) Certified Colour Analyst (16-23 Season System) and Certified Personal Stylist.

3. Bookings and Payment

3.1 Booking Process

All bookings are made via our official website. A booking is considered confirmed only upon receipt of full payment.

3.2 Payment

Payment is required in full at the time of booking. We accept payments via UPI, bank transfer, and all major debit and credit cards. Cash payments are not accepted.

Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. International clients may be quoted in USD or INR as communicated at the time of enquiry.

3.3 Pricing Changes

We reserve the right to revise our pricing at any time. Any changes will not affect bookings that have already been confirmed and paid for.

3.4 Client Consultation Form

Upon confirmed payment, you will receive a booking confirmation email along with a client consultation form. The form must be completed within 7 days of payment and appointment confirmation, and no later than 72 hours prior to your session, whichever comes first.

The consultation form is required to prepare for your session and, where applicable, to ensure that the requested photographs and information are received in sufficient time. If the form is not completed by the required deadline, Hue Got Styled by Neeti Sarkar reserves the right to cancel or reschedule the appointment, subject to availability. No refund will be issued in such cases, as the appointment slot has been reserved exclusively for you.

3.5 Client Acknowledgement of Accuracy

By completing your booking, you confirm that all information provided, including photographs, personal details, and responses on the consultation form, is accurate and complete to the best of your knowledge. Hue Got Styled by Neeti Sarkar cannot be held responsible for inaccurate results arising from incorrect or misleading information submitted by the client.

 

4. Cancellation, Rescheduling, and No-Show Policy

4.1 Cancellations by You

• Cancellations made 72 hours or more before the scheduled session: eligible for a full refund or credit toward a future session.

• Cancellations made within 72 hours of the session: No refund will be issued. Rescheduling may be offered subject to availability and at the discretion of Hue Got Styled by Neeti Sarkar.

All cancellation requests must be submitted in writing via email or WhatsApp message.

4.2 Rescheduling

• You may reschedule your appointment at no charge if notice is given at least 72 hours in advance.

• Rescheduling requests made within 72 hours of the session are subject to availability.

• A session may be rescheduled only once. Subsequent rescheduling requests will be treated as a new booking.

4.3 No-Show Policy

If you do not attend your session without prior notice, the session will be forfeited and no refund or credit will be issued. After two no-shows, we reserve the right to decline future bookings.

4.4 Delay In Arrival

If you arrive more than 15 minutes after your scheduled appointment time, we reserve the right to treat the session as a no-show. Late arrivals affect the sessions of other clients and we are unable to guarantee that a full session can be completed within the remaining time. In such cases, the session will be forfeited and no refund or credit will be issued. If you anticipate being late, please inform us as soon as possible. We will do our best to accommodate you where our schedule allows, but this cannot be guaranteed.

4.5 Cancellations by Hue Got Styled

In the unlikely event that we need to cancel a confirmed session due to illness, emergency, or circumstances beyond our control, we will notify you as soon as possible and offer either a full refund or priority rescheduling at your convenience. We shall not be liable for any additional costs, losses, or inconveniences arising from such cancellations.

4.6 Group Appointments for Couple or Group Sessions

All participants must be present at the scheduled appointment time. If any participant is absent or significantly delayed, the session may need to be rescheduled for the entire group. Rescheduling in such cases will be subject to availability and the terms outlined in Section 4.2.

 

5. Refund Policy

Refunds are available only in accordance with the cancellation terms outlined in Section 4.

As colour analysis and styling consultations are personalised services delivered based on individual assessment and professional expertise, completed sessions are non-refundable. Refunds will not be provided based on disagreement with, dissatisfaction with, or personal preference regarding the results, recommendations, colour palette, or styling guidance provided during a completed session.

All digital products, including PDF colour reports, digital style guides, and downloadable content, are non-refundable once delivered or access has been granted, as they constitute personalised, immediately accessible content.

If you experience a technical issue preventing access to a digital product, please contact us within 7 days of purchase and we will make reasonable efforts to resolve the issue.

6. Session Requirements and Client Responsibilities

6.1 In-Person Sessions for Individual and Group Sessions

• Age Requirement: 18+

For the most accurate colour analysis results, clients are advised to:

• Arrive with clean skin. Your face and neck needs to be free of any type of makeup, foundation, tinted moisturiser, and heavy skincare products.

• Avoid wearing any pigmented products including lip colour, blush, bronzer, or eyeshadow /eyeliner/kajal/mascara to the session. If you have an artificial tan or have used self tanner, we will not proceed with the session.

• Do not wear perfume or cologne to the session. The ingredients (alcohol and oils) in it affect the drapes used. A water-based body mist spray is permitted. 

• Come with your natural hair colour visible, or inform us in advance if your hair is coloured, highlighted, or otherwise chemically treated (through the consultation form received upon booking your appointment).

• Wear a simple, neutral-coloured top if possible (grey, white, beige). Avoid tops/shirts with collar/high-neck.

• Avoid coloured or tinted contact lenses for the session. If you wear prescription lenses, clear lenses are preferred; otherwise, please bring your glasses as an alternative.

• Jewellery including earrings, necklaces, and other accessories should be removed before the session begins, as metals and coloured stones can interfere with the draping process.

• Spectacles will need to be removed for portions of the session. If you wear prescription glasses and are unable to see without them, please let us know.

• Studio Lighting: Colour analysis sessions use professional studio lighting in addition to natural light as part of the assessment process and to support accurate colour evaluation. The lighting may be bright or intense. If you have a known sensitivity to bright or studio lighting, please inform us before the session begins so that we can manage the session flow and make reasonable adjustments where possible. By attending the session, you acknowledge that professional studio lighting will be used as part of the colour analysis process.

Failure to follow these guidelines may affect the accuracy of your results. We reserve the right to not proceed with your session if these guidelines are not adhered to in part or in full.

• Sessions are conducted at a private home studio. Individuals below the age of 18 are strictly not permitted on the premises during appointments. We request that clients make alternative arrangements for childcare prior to their session.

• Food and beverages (including water bottles, coffee, and snacks) are not permitted in the studio. This is to protect the draping fabrics, colour tools, and materials used in your analysis. We kindly request that you have a meal before arriving.

6.2 Nature of Service and Disclaimer

Colour analysis is an interpretive, education-based service. All recommendations, including colour palettes, digital reports, and styling guidance, are based on professional expertise and the information provided by the client. Results may vary depending on individual characteristics, lighting conditions, and personal implementation. 

Please note that results may also differ across practitioners and colour systems. Hue Got Styled by Neeti Sarkar makes no guarantees regarding specific outcomes. Our services are intended as guidance only and do not constitute medical, dermatological, or psychological advice.

The consultation provides personalised professional guidance and education based on Hue Got Styled's methodology and expertise; it is not a training session or professional certification. Clients are encouraged to use their own discretion when applying the recommendations provided.

7. Intellectual Property

All content created, produced, and delivered by Hue Got Styled by Neeti Sarkar, including but not limited to colour reports, style guides, digital palettes, written content, imagery, templates, educational materials, session recordings, and social media content, is the exclusive intellectual property of Hue Got Styled by Neeti Sarkar and is protected under applicable copyright law.

You may use the materials delivered to you for your own personal, non-commercial purposes only. You may not:

• Reproduce, copy, distribute, or share the materials with third parties on any platform, online or offline.

• Use the materials for commercial purposes, resale, or professional training.

• Present our content, palettes, or reports as your own work.

​The consultation itself, including verbal explanations, demonstrations, analysis, methodology, processes, techniques, frameworks, professional observations, and other proprietary information shared or demonstrated during a session, forms part of the proprietary professional service provided by Hue Got Styled by Neeti Sarkar. Clients and accompanying persons may not record, reproduce, document, copy, teach, distribute, commercially use, or otherwise exploit any substantial part of the consultation or its methodology without prior written permission from Hue Got Styled by Neeti Sarkar.

Attendance at a consultation does not grant any licence or permission to learn, reproduce, adapt, teach, or commercially apply Hue Got Styled by Neeti Sarkar's methodology, systems, processes, tools, or techniques for professional purposes.

8. Photography, Recording, and Promotional Use

8.1 All Colour Analysis sessions are recorded by Hue Got Styled by Neeti Sarkar as part of the service and are used for quality assurance, internal training, and preparation of your personalised report and other service deliverables.

By booking a Colour Analysis session, you acknowledge and agree to this recording and documentation as a condition of the service.

Recordings and photographs will not be shared publicly or used on social media, our website, or other promotional platforms without your separate, explicit consent. Consent for such promotional use will always be sought in person, orally, during or after your session, before any such content is used publicly.

You may withdraw your consent for future promotional use at any time by contacting Hue Got Styled by Neeti Sarkar in writing. Upon withdrawal of consent, we will remove the relevant photographs, recordings, testimonials, or other promotional content from our social media, website, or other promotional platforms within a reasonable timeframe.

Hue Got Styled by Neeti Sarkar will never share, publish, or use client photographs, recordings, testimonials, or personal information for promotional purposes without prior consent.

Session recordings are confidential and contain the intellectual property of Hue Got Styled by Neeti Sarkar. Recordings are retained for the purposes stated above and are not shared or provided to clients under any circumstances.

8.2 Recording, Photography & Documentation by Clients and Accompanying Persons

• Brief photographs or video clips for personal use or social media may be permitted during the session at the discretion of Hue Got Styled by Neeti Sarkar, provided they do not capture or document the substantive consultation, analysis, methodology, explanations, demonstrations, processes, techniques, tools, or proprietary materials.

• Clients and accompanying persons may not audio-record, video-record, screen-record, photograph, or otherwise document the consultation, or any substantial part of the analysis, methodology, explanations, demonstrations, processes, techniques, tools, or proprietary materials used during the session, without prior permission from Hue Got Styled by Neeti Sarkar.

• Any permission granted for brief photographs or video clips does not constitute permission to record or reproduce the consultation itself or to document Hue Got Styled by Neeti Sarkar's methodology, processes, techniques, or proprietary materials.

9. Privacy and Confidentiality

We take your privacy seriously. All personal information, photographs, and data collected during the booking and service process are:

• Stored securely and used solely for the purpose of delivering your services.

• Treated as strictly confidential.

• Not sold or disclosed to third parties except where required to deliver the Services, comply with legal obligations, or where you have provided consent.

By booking our services, you consent to us collecting and using your personal data as described above and in our Privacy Policy. Our data practices are consistent with applicable Indian data protection regulations.

10. Digital Products and Delivery

Digital products (including colour reports, style guides, and other downloadable resources) will be delivered via email or a secure client portal within the timeframe communicated at the time of purchase.

Please ensure that the email address provided at booking is accurate and active. Hue Got Styled by Neeti Sarkar is not responsible for non-delivery caused by an incorrect email address provided by the client or by emails being directed to spam, junk, or other filtered folders.

All digital products are for the personal use of the purchasing client only and may not be shared, forwarded, or reproduced (see Section 7).

11. Service Validity and Expiry

Bookings and gift vouchers must be redeemed within 12 months of purchase. Services not used within this period will lapse without refund.

12. Communication and Response Times

We endeavour to respond to all enquiries received via email, WhatsApp, or our website within 24 to 48 hours on working days (Monday through Friday, excluding public holidays). Enquiries received on weekends or public holidays will be addressed on the next working day.

Response times may vary depending on the volume and complexity of enquiries. Hue Got Styled by Neeti Sarkar does not guarantee responses within a specific timeframe but will always make reasonable efforts to get back to you promptly.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Hue Got Styled by Neeti Sarkar shall not be liable for:

• Any indirect, incidental, or consequential losses arising from the use of our services or digital content.

• Decisions made regarding wardrobe, shopping, personal presentation, or other personal choices based on our recommendations.

• Any dissatisfaction with or disagreement regarding colour analysis results, colour recommendations, styling recommendations, or other professional guidance provided as part of the Services.

• Losses or damages arising from circumstances beyond our reasonable control, including technical failures, force majeure events, illness, or natural disasters.

Our total liability in any circumstance shall not exceed the amount paid by you for the specific service in question.

14. Client Conduct

• We are committed to providing a respectful, inclusive, and professional environment for all clients. We ask that clients engage with us in a courteous and respectful manner across all channels of communication.

• Clients and accompanying persons are expected to take reasonable care of Hue Got Styled by Neeti Sarkar's studio, equipment, tools, materials, products, and other property. Where any property is damaged or lost as a result of a client's or accompanying person's behaviour, misuse, or negligence, Hue Got Styled by Neeti Sarkar reserves the right to seek reasonable compensation for the resulting repair or replacement costs, as applicable.

• Hue Got Styled by Neeti Sarkar reserves the right to decline or discontinue service at any time if a client is found to be behaving in a manner that is disrespectful, abusive, discriminatory, or otherwise inappropriate. In such cases, no refund will be issued for services already partially rendered.

15. Professional Exclusion Policy

15.1 For Clients

Colour analysis services offered by Hue Got Styled by Neeti Sarkar are intended exclusively for personal use by private individuals. In order to protect the integrity of our methodology, tools, and intellectual property, we do not offer services to:

• Practising colour analysts, regardless of the system or institution they are trained in

• Formally trained or untrained individuals offering colour analysis services independently or as a part of other styling/image consulting/beauty/fashion design services

• Individuals currently undergoing training in colour analysis, in any system or program

• Individuals who have studied colour analysis as part of a broader course or program, including but not limited to image consulting, personal styling, fashion styling, or related fields.

Our sessions are personal consultations designed for clients seeking guidance on their own colouring and wardrobe. They are not a platform for observing methodology, acquiring tools, or gaining professional exposure to our systems or approach.

If you fall into any of the above categories, we would encourage you to seek your colour analysis from the institution or trainer you are studying or have studied with, as they will be best placed to work within the system you are learning.

By completing your booking and submitting your consultation form, you confirm that none of the above applies to you. If it is found at any point - before, during, or after a session - that a booking was made in breach of this policy, Hue Got Styled by Neeti Sarkar reserves the right to cancel the session immediately with no refund, and to take appropriate legal action in the event of misrepresentation or misuse of our intellectual property, systems, or materials.

15.2 For Attendants

Due to the size and nature of the studio, a maximum of one adult attendant is permitted to accompany a client to an in-person consultation. Accompanying persons must be disclosed in the consultation form prior to the session. Additional accompanying persons will not be permitted to attend the session.

The Terms of Service apply to any accompanying person attending a consultation. An accompanying person may not attend for the purpose of observing, studying, documenting or gaining professional exposure to Hue Got Styled's methodology, processes, tools or techniques. Hue Got Styled by Neeti Sarkar reserves the right to ask an accompanying person to leave the consultation if their attendance is inconsistent with this policy.

An accompanying person's professional or educational background does not, by itself, prevent them from attending a consultation. However, all accompanying persons are required to comply with this policy and the applicable Terms of Service while attending the session. In such an event where there is non-compliance from the attendant, and they are therefore, asked to leave the session, and the client chooses not to proceed with the session without them, the session will be cancelled and there will be no refund offered.

16. Amendments to These Terms

We reserve the right to update or amend these Terms of Service at any time. Any changes will be posted on our website with a revised effective date. Continued use of our services following an update constitutes acceptance of the revised Terms.

It is your responsibility to review these Terms periodically. We recommend saving or printing a copy for your records at the time of booking.

17. Governing Law and Dispute Resolution

These Terms of Service are governed by and shall be construed in accordance with the laws of India. Any disputes arising from these Terms or from the services provided shall first be attempted to be resolved informally through direct communication.

 

In the event that a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.

By booking a service or purchasing a product from Hue Got Styled by Neeti Sarkar, you confirm that you have read, understood, and agreed to these Terms of Service.
